Privacy Policy

Effective April 15, 2011

This Privacy Policy is by and between StudioVox, Inc. (the "Company", "StudioVox", "we", "us" or "our") and you (a "Member", "you", or the "user" and one of the "users") and sets forth the policies and practices for the collection of data and usage of information that apply to your use of StudioVox's services and network (the "Service") that are delivered via the StudioVox website http://www.studiovox.com (the "Site") or devices such as mobile phones, tablet computers, netbooks, electronic readers, and computers (each a "Device").  By accessing the Site or using the Service or any portion thereof, you accept the practices described in this Privacy Policy.  This Privacy policy does not apply to any other information collection activities of Studiovox.

We respect the privacy of all users of the Service, and unless otherwise set forth in this Privacy Policy, we will not release your personal information without your permission.   This Privacy Policy is incorporated into the StudioVox Terms of Use, which together with the StudioVox Copyright Policy form the "Agreement".  However, the Service is a social networking site connecting our users with other creative people and providing a broad range of features specifically for creative promotion, allowing our users to share with other users their creative portfolios and to view each other's profiles.  Members (defined below) may make posts and comments, communicate with other Members, publish personal or professional news, search for other creative professionals, and network through blogs and forums to exchange ideas and find new projects.  To enrich our users' experience, we request and display some personal information to other users, which allows our users to identify each other and expand their online social networks through the Service. 

  1. Sharing and Disclosure of Personal Information

    "Personal Information" is unique information that identifies you, or any other person, as a distinct and identifiable individual.  Personal Information includes, without limitation, information such as your name, email address, phone number, a credit card, billing and shipping addresses and a password chosen by you that identifies you as a Member.  Except as provided in the Agreement, we do not sell, re-sell, or otherwise distribute Personal Information.  However, when you designate or post information to be displayed publicly for others to see, your information may be displayed. This may include information posted to your Member Profile, or posted on a public forum or message board on the Site.  For example, other users of the Service will be able to see information posted on your Member Profile (defined below). You may also add additional optional information to your Member Profile, and you may control what type of information is shown to others on your Member Profile by choosing to limit the information you include on your Member Profile.  Please see Section 1(b) below for more information on how information posted on a Member Profile will be shared.  

    Except as may be required to verify compliance with the Agreement, the Company does not read your online communications when you use any of the private, internal communication tools offered through the Service. If, however, you use these tools to disclose information about yourself publicly (for example, on other Member Profiles or blogs and forums made available by the Service), other online users or third parties may obtain access to any information you publicly provide.

    Except as otherwise described in the Agreement, we will not disclose Personal Information to any third party unless we believe that disclosure is necessary to: (i) conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Company, whether or not a response is required by applicable law; (ii) enforce the Agreement or to protect our rights; or (iii) protect the safety of members of the public and users of the Service.    

    We disclose information to companies and individuals we employ to perform functions on our behalf or that provide part of the Service.  Examples include hosting our web servers, analyzing data, providing marketing assistance, and providing customer service.  Additional examples may include licensors, subsidiaries, affiliates, distributors and suppliers.  These companies and individuals will have access to your Personal Information as necessary to perform their functions, but they may not share that information with any other third party. 

    We reserve the right to transfer Personal Information to a successor in interest that acquires rights to that information as a result of the sale of the Company or a transfer of all or substantially all of its assets to that successor in interest.  The Company further reserves the right to cooperate with legal authorities and third parties in the investigation of alleged wrongdoing, including disclosing the identity of a user that the Company deems responsible for any wrongdoing.

  1. Member Account.  Some features of the Service are only available to users who have registered themselves with the Company as a "Member" of the Site and the Service and created a "Member Account." You may be identified as a Member and create a Member Account by providing the Company with your full legal name, email address, username, and a password chosen by you.  In order to purchase a subscription to the Site, Members will also have to provide StudioVox with certain credit card information such as you credit card number, billing address and phone number. Third party applications may permit you to associate your existing third party profile with your Member Account. The Company may also access certain profile information contained within your third party profile such as your screen name and your profile picture.  Your Member Account identifies you to the Company and may also contain your personal preferences and saved items.  To modify any Member Account, please log into your account and click on "account information". Although we allow you to set privacy options that limit access to certain of your information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We are not responsible for third party circumvention of any privacy settings or security measures on the Site. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus/antispam/antispyware software. 

    Member Profile. Members of the Site can create a unique identifying personal user profile, which is used to participate in the services and features offered through the Service ("Member Profile").  Your name and the username chosen when you created your Member Account will always be displayed on your Member Profile. However, Members may choose to include optional information in their Member Profile including, without limitation, information such as an email address, photographs uploaded by the Member, personal interests, date of birth, schools attended, location, academic degrees or certifications, skills, occupation, groups you belong to, galleries exhibited, work shown, place of work, verification that you are over 18, as well as uploaded media including pictures, videos or music. Any personal information or other content that is voluntarily disclosed in our system, available in your Member Profile or otherwise made available through materials you post to the Site becomes available to view by anyone.  Links to your Member Profile may be included on other Studiovox profiles. PLEASE NOTE THAT, REGARDLESS OF WHAT INFORMATION YOU CHOOSE TO INCLUDE IN YOUR MEMBER PROFILE, OR WHAT PRIVACY PREFERENCES YOU MAINTAIN, YOUR NAME AND USERNAME WILL ALWAYS BE INCLUDED IN YOUR MEMBER PROFILE AND MAY BE ACCESSIBLE TO ANYONE VISITING YOUR MEMBER PROFILE ON THE SITE. 
  2. Email and Telephone Number Policy.  You are required to provide an email address when you create a Member Account. We will not share, sell, rent, swap or authorize any third party to use your email address or phone number without your permission. Your personal email address or phone number is not shared or displayed to other users, unless you publicly post such information (for example, on other Member Profiles, in chat rooms or online message boards made available by the Service).  We may use your email address or phone number to send you updates, text messages, a newsletter, or news regarding the Service; users may choose not to receive email of this type by changing their "notification" setting to "Do not send me notifications".  
  3. StudioVox Business Partners.  StudioVox may work with third-party advertising companies, sponsors and other companies ("Business Partners") to place advertising on the Site and in email communications sent to our Members regarding the Site and the Service.  StudioVox may correlate or match registered Members' information, including Personal Information, with information held by our Business Partners to target ads or otherwise improve the effectiveness of the Service.  Business Partners may also from time to time sponsor special offers or promotions which may require you to connect to the Business Partner's website and complete a separate registration process and such process may require you to share your Personal Information.  If you purchase goods or services offered through Studiovox by a Business Partner, then you may be required to submit Personal Information in order to complete the transaction and Studiovox may provide your Personal Information to such Business Partner for that purpose. In some cases, we may enter into a promotional relationship with a Business Partner in which we prominently display their brand name or trademarks on pages that appear the same as or very similar to the pages of the Service. These pages are known as "Co-Branded Pages" and these particular Business Partners are known as "Co-Branded Business Partners". If the page on which you submit information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then we may share your Personal Information with the associated Co-Branded Business Partner. Additionally, you agree that we may use and disclose all information submitted to such Co-Branded Business Partners in the same manner in which we are entitled to use and disclose any Personal Information or Non-Personal Information otherwise submitted to us. Please note that Co-Branded Business Partners may use your Personal Information in accordance with their own privacy policies and you should contact a Co-Branded Business Partner if you have questions regarding the use of your Personal Information by them. 
  4. Surveys and Promotions.  We may conduct surveys or sponsor promotions, sweepstakes, or contests through the Service.  You may be asked to provide Personal Information including name, phone number, email address or home address, or you may be asked to answer additional questions in order to participate.  Furthermore, we may transfer Personal Information to certain ad partners that you have explicitly requested to receive information from.  It will be clear at the point of collection who is collecting the Personal Information and whose privacy statement will apply.
  1. Non-Personal Information

    "Non-Personal Information" is information that does not specifically identify you or any person as an individual, and includes, but is not limited to, such non-unique information obtained from users of the Service like aggregated data, web-browser type, browsing history, Internet protocol ("IP") address or an internet service provider.  Non-Personal Information is used to manage the Site, track usage and improve the Service and is not linked to any Personal Information.  Non-Personal Information may be shared with third-parties to provide more relevant services and advertisements to users.  

  1. Aggregate Data.  Non-Personal Information may be collected about your usage of the Site or the Service or retrieved from your Member Account and aggregated with data from other users ("Aggregate Data").  This Aggregate Data is anonymous and will not contain any Personal Information.  Aggregate data is collected to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users.  We may provide statistical information based on this data to advertisers and other current and potential Business Partners.  See Section 1(d) above for more information on our Business Partners. 
  2. IP Addresses.  When you visit our site, we log standard information such as your IP address, which is a number that can be used to identify your location and Internet Service Provider, along with the URL from which you came to our site and the URLs visited on our site. A URL is the full address of a Web site page, which may or may not contain some Personally Identifiable Information about the person who is viewing it.  When we send messages to you or others, we may provide a URL link to the Studiovox site that contains an alphanumeric identifier, which allows us to identify the person to whom we sent the message so that we can personalize our content for that individual.
  3. Advertisements.  Advertisements appearing on the Site may be delivered to you by us or by one of our advertising partners.  Our advertising partners may set cookies which will allow the ad server to recognize your computer each time an advertiser sends you an online advertisement.  In this way, ad servers may compile information about where you, or others who are operating your computer, saw their advertisements and determine which ads are clicked through by you.  This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.  We do not control these third-party cookies.  Use by advertisers of cookies is subject to their own privacy policies, not this Privacy Policy.
  4. Cookies.  Cookies are small text files that are placed on your computer's hard drive by a webpage server.  Cookies are used to store a visitor's preferences and to record session information.  Cookies are also used to prevent duplicative advertisements and to customize newsletter, advertising, and content on the Site and through the Service based on a user's browser type and Member Account information.  We do not link the information we store in cookies to any Personal Information you submit while on our site.  Advertisements appearing on the Site or through the Service may be delivered to you by us or by one of our advertising partners.  Our advertising partners may set cookies, which will allow the ad server to recognize your computer each time an advertiser sends you an online advertisement.  In this way, ad servers may compile information about where you, or others who are operating your computer, saw their advertisements and determine which ads are clicked through by you.  This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.  We do not control these third party cookies and advertisers' use of cookies is subject to their own privacy policies, not this Privacy Policy.  You may be able to configure your browser to accept or reject all or some cookies, or notify you when a cookie is set.  Each browser is different.  Refer to the "Help" menu of your browser to learn how to change your cookie preferences.  However, please note that YOU MUST ENABLE COOKIES ON YOUR BROWSER IN ORDER TO USE MANY FUNCTIONS OF THE SITE OR THE SERVICE.
  5. Web Beacons. The Site may contain electronic images known as Web Beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages and to deliver co-branded services.  Web Beacons are not used to access your Personal Information; they are a technique used to compile aggregated statistics about use of the Site.  Web Beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides.  You may not decline Web Beacons, however, they can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. However, please note that YOU MUST ENABLE COOKIES ON YOUR BROWSER IN ORDER TO USE MANY FUNCTIONS OF THE SITE OR THE SERVICE. 
  1. Third Party Tools

    To help facilitate user registration, and to increase the usefulness of the Service to our users, we offer third party tools, including a single sign-on service that allows you to sign into your Member Account by using your third party login credentials. This allows you to associate your existing third party profile with a Studiovox Member Account.  You can disassociate your Member Account from a third-party registration account at any time. 

  2. Third Party Links and Advertisements

The Service may provide you with content from third parties and links to third party websites.  We may also carry advertisements from other companies.  We are not responsible for the privacy practices of websites or other services operated by third parties that are linked from the Site or integrated with the Service, or for the privacy practices of third party Internet advertising companies.  Once you access such links on the Site or through the Service, leave the Service or the Site via such a link, access a third party application (such as widgets), or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any information they collect from you.  

  4. Public Forums/Chats/Blogs

If you post on a public section of the Service, such as a bulletin board, forum or blog, or participate in a chat room on the Sites, you should be aware that any Personal Information you choose to provide there can be read, collected, or used by other users of these forums, as well as other third parties, and could be used to send you unsolicited messages.  We are not responsible for the Personal Information you choose to submit in these public areas of the Service. StudioVox reserves the right to take necessary action to preserve the forum's integrity, such as removing any posting that is vulgar, off-topic, or inappropriate.  See the "Prohibited Conduct" Section of the Terms of Use.  

  6. Children Under Age 13
  7. The Company compiles with the Child Online Privacy and Protection Act.  Members of the Service must be aged 13 years or older.  Unless we have permission from the legal guardian of a user who is under 13 years of age, we do not allow persons under age 13 to create a Member Account nor do we knowingly collect or solicit Personal Information from anyone under the age of 13.  In the event that we learn that information has been collected from a child under age 13 without verification of parental or guardian consent, that information will be deleted as quickly as possible.  If you believe that we might have any information from or about a child under 13, please contact us.

  8. Changes in Our Privacy Policy
  9. We will occasionally update this Privacy Policy to reflect changes in our services and customer feedback. When we post changes to this Privacy Policy, we will revise the "effective" date at the top of this Privacy Policy.  If there are material changes to this statement or in how we will use your Personal Information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification.  We encourage you to periodically review this statement to be informed of how we are protecting your information.

  10. Security

We use commercially reasonable measures to protect your information that is stored within our database, and we restrict access to user information to those companies and individuals we employ or contract with that need access to perform their functions, such as our customer service personnel and technical staff.   Member Accounts are secured by user-created passwords.  Please note that we cannot guarantee the security of Member Account information, including that information on your Device.  Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

  12. Opt-Out/Modify 
  13. We provide every Member with the opportunity to opt-out of receiving future communications from us, change and modify information previously provided, or remove their information from our databases altogether. You may do so in any of the following ways:

  14. Business Transitions
  15. In the event the Company enters into a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, your Personal Information may, and in most instances, will be considered, be part of the assets transferred.

  16. Miscellaneous 
  17. By using the Site or Service, you agree that this Privacy Policy is governed by California law and that any and all controversies arising under this Privacy Policy shall be resolved exclusively by the state or federal courts located in in Los Angeles County, California.
